Ex-FBI Agents Sue Director Kash Patel Over Alleged Unlawful Firings

Two former FBI special agents claim their terminations violate the U.S. Constitution, citing minimal roles in the Trump investigation

Two former FBI special agents who worked on the investigation that led to criminal charges against President Donald Trump have filed a lawsuit against FBI Director Kash Patel and Attorney General Pam Bondi. The agents, who have chosen to remain anonymous, allege that their firings were "unlawful" and violate the U.S. Constitution. The lawsuit claims that the agents played minimal roles in the investigation, known as "Arctic Frost," and that their terminations were a result of Patel's routine firing of FBI special agents tied to investigations into Trump.

Background on the Investigation

The "Arctic Frost" investigation was opened in early 2022 and was overseen by former special counsel Jack Smith. The investigation led to Trump being indicted on four charges in August 2023. However, after Trump won the 2024 presidency, Smith moved to dismiss the case due to long-standing Justice Department policy stating that sitting presidents can't face charges. Despite the dismissal, Smith maintained that his office secured "proof beyond a reasonable doubt" that Trump engaged in a "criminal scheme" to overturn his 2020 election loss. Trump has called for Smith to be "investigated and put in prison."

The Agents' Roles in the Investigation

The two agents who filed the lawsuit were both fired late last year. According to the lawsuit, one of the agents, known as John Doe 1, had "largely administrative and ministerial" contributions to the "Arctic Frost" investigation. He was preparing to go trick-or-treating with his two children on Halloween when he was called to report to the main Washington Field Office location in D.C. The lawsuit states that John Doe 1 was given no opportunity to transition his fraud investigations to other agents after his work on the Trump investigation, and he worries that those cases may be lost, forgotten, or dismissed now. The second agent, known as John Doe 2, played a "supporting role" in the investigation and was never one of the primary or lead agents. He returned to his unit, which focused on public corruption involving local D.C. elections and officials, in June 2023, before Trump was indicted.

The Agents' Claims and Patel's Response

The lawsuit claims that the two former FBI special agents "fully adhered to FBI and DOJ policies and procedures" and "executed their law-enforcement duties without bias or political motive." The agents' attorneys wrote in a filing that publicizing their names would "pose a new threat to plaintiffs — not simply harming their employment prospects, but rather placing their actual physical safety and mental health newly at risk." In response to the lawsuit, the FBI declined to comment on the pending litigation. Patel has broadly said that those who were fired were "weaponizing law enforcement." In a termination letter for one of the agents, the FBI said that the agent had "exercised poor judgment and a lack of impartiality in carrying out duties, leading to the political weaponization of the government." The lawsuit alleges that this claim is unfounded and that the agents' firings were a result of Patel's targeting of agents who worked on investigations into Trump.
