Protected Status, Harsh Reality: Abused Immigrant Youth Detained and Deported

Hundreds of young immigrants, granted special status designed to shield them from harm, faced detention and deportation under the Trump administration, raising significant questions about federal policy.

Vulnerable Youth Face Federal Action

Young immigrants who experienced abuse or abandonment in their home countries are granted a path to a green card through Special Immigrant Juvenile Status (SIJS), a protection established by Congress in 1990. This status aims to provide a way for these minors, who must be under 21 when they petition, to remain in the U.S. and obtain legal residency. However, a recent report reveals that a number of these vulnerable individuals faced detention and deportation.

From January 20 to December 22 of a recent year, during the Trump administration's tenure, U.S. Immigration and Customs Enforcement (ICE) detained 265 and deported 132 young individuals holding SIJS. This data emerged from a Department of Homeland Security (DHS) letter sent to Senator Catherine Cortez Masto (D-Nev.), exclusively obtained by NBC News.

Rachel Davidson, director of the End SIJS Backlog Coalition, part of the National Immigration Project, commented on these actions, stating, "They are tearing them away from the stability that they’re in, the lives that they’re building on their pathway to permanent protection."

Senator Cortez Masto emphasized the legislative intent behind SIJS. "We have specifically identified them because they are fleeing their countries in horrific conditions," she told NBC News. "We do not want them to be further harmed or exploited in our country, so we have created specific provisions under the law so that we are looking out for their best interest."

Policy Shifts and Justifications

Youths with SIJS often relied on a policy known as deferred action, which shielded them from deportation and allowed them to work legally in the U.S. while awaiting their green cards due to a backlog in applications. According to the report, this protection had typically been in place for SIJS youths since 2022. However, the Trump administration ended deferred action for SIJS recipients in June. This policy reversal is currently on hold as it proceeds through a court case.

U.S. Citizenship and Immigration Services (USCIS) offered a justification for its stance in June, stating that Congress “did not expressly permit deferred action and related employment authorization” for SIJS recipients. The agency also contended that the lack of immediately available visas, partly due to the backlog, and juvenile courts’ recommendations for the youths to remain, were not “sufficiently compelling reasons” to allow them to stay under deferred action.

Emma Israel, senior policy analyst at Kids in Need of Defense, a non-governmental organization advocating for unaccompanied and separated children, expressed surprise at the figures. She indicated that the DHS statistics were “much higher than we expected.” DHS attributed the deportations of the 132 individuals to immigration violations, such as being in the country without admission or not possessing valid visas. Federal data did not disclose whether any of the deported youths faced criminal charges or convictions.

The Case of Elias

Attorneys are currently fighting for the return of a 16-year-old, identified as Elias, who was reportedly deported to Guatemala in May. This deportation occurred despite his having been granted special immigrant juvenile status, according to court documents, in July 2024.

Court documents petitioning for his return describe Elias's journey. He arrived in the U.S. alone at age 14 in 2023, having suffered “severe physical and emotional abuse and neglect at the hands of his mother.” His injuries from physical abuse were so severe that they required hospital admission. Elias reportedly endured constant neglect, often left alone for days or weeks without access to food. Although other family members attempted to assist him, Elias lived in fear of his mother and her partner, turning his home into a place of anxiety and danger.

After being released from immigration custody, Elias lived with his father and other relatives in Louisiana. However, in April of a recent year, USCIS terminated Elias's deferred action. According to the complaint, this action occurred "without providing any advance notice or an opportunity to respond, and without any explanation." The following month, ICE briefly detained Elias’s father, instructing him to return to Guatemala with his children. Elias was then reportedly deported to Guatemala by ICE agents in the early hours of May 21, 2025.
