Virginia Democrats Grapple With Uncertainty Over Critical Redistricting Referendum

Doubts Emerge Over Strategic Map

After pushing an aggressive redrawing of the state's congressional map to voters, some Virginia Democrats are growing uneasy about its potential for passage. This comes less than a month before a special election scheduled to decide the matter. Democrats had entered the current political cycle with a wave of momentum, having successfully flipped the governorship and expanded their majority in the state House in last fall's elections. They also hold substantial fundraising and advertising spending advantages leading into the April contest.

However, the realities of campaigning for a unique ballot measure in Virginia, a state that is not as reliably Democratic as California, have begun to set in. California voters approved a redrawn map through a similar process last year. Supporters of the Virginia referendum acknowledge the difficulty of persuading voters to back a map that some might perceive as gerrymandering. This challenge is particularly acute given that Democrats, who several years ago supported the formation of the state's bipartisan redistricting commission, have previously criticized Republicans for similar partisan moves.

Representative Don Beyer, a Democrat from Virginia, underscored the high stakes. "It’s not a done deal by any means," he stated. "We have to effectively make the case that even though this seems unfair in Virginia, it’s totally fair for America, for those of us who believe that taking back the House is the most significant thing we can do to stop Donald Trump." Under the proposed map, Democrats could potentially gain as many as four of the five seats currently held by Republicans in Virginia during this fall's midterm elections, a period when control of the narrowly divided U.S. House of Representatives will be fiercely contested. In contrast, Democrats in deep-blue California anticipate picking up five of eight Republican-controlled seats with their newly drawn congressional boundaries.

Unpredictable April Election Dynamics

An anonymous Democratic operative close to the campaign supporting the measure highlighted the differences between the two states. "It’s very easy to say, 'Well, California just did this, and therefore the same thing is going to happen in Virginia.' But that ignores the reality that Virginia is a purple state," the operative explained, speaking candidly.

Adding to Democrats' anxieties are several factors unique to Virginia's political landscape. Voters in the state are not accustomed to going to the polls in April, the month Democrats selected for the special election, making turnout particularly unpredictable. Recent polling shows mixed views on the ballot referendum, and early voting numbers have reportedly shown some favorable trends for Republicans. The operative further elaborated on the challenges of voter engagement: "There’s a lot of factors you can’t control about who’s going to be an active participant in this election until the last minute. It’s a random April election. We’re talking about reaching voters who are taught to check out around this time of year and check back in the summer."

A Complex Battle with Legal Nuances

The April election in Virginia represents the latest front in an unusually active mid-decade redistricting battle across the nation. This push in Virginia emerged in response to former President Donald Trump's urging of GOP-led states to redraw their maps to solidify the party's narrow House majority. Last year, six states, including Texas, Missouri, and North Carolina on the Republican side, enacted new maps, while the most significant Democratic counterattack unfolded in California.

The process in Virginia has proven exceptionally complex. Before placing the map on the ballot, lawmakers were required to pass a constitutional amendment to temporarily bypass the state’s redistricting commission. This process necessitated approval during two separate legislative sessions, with a statewide election taking place in between them.

Adding another layer of uncertainty, voters may not even have the final say on the matter. While the Virginia Supreme Court has permitted the special election to proceed, it has also reserved the right to rule on the legality of the measure after the race concludes, potentially leaving the ultimate fate of the map in judicial hands.

Financial Advantage Amid Political Jitters

Despite the growing apprehension among some Democrats, the main group supporting the redistricting referendum has established a significant financial advantage. This organization, known as Virginians for Fair Elections, has already spent or reserved an impressive $17.2 million on advertisements from January 1 through April 21, according to data from the ad-tracking firm AdImpact.
